Is ChatGPT GDPR Compliant?

Verdict: Partially — it depends on which plan you use

ChatGPT is not fully GDPR compliant on the free and Plus plans for business use. The Team and Enterprise plans offer GDPR-grade protections including a Data Processing Agreement. If you handle personal data, you need a paid business plan.

The Free and Plus Plans — Use With Caution

On ChatGPT's free and Plus plans, OpenAI may use your conversations to improve their models by default. You can opt out in Settings → Data Controls → turn off "Improve the model for everyone" — but this requires deliberate action and is not the default.

More importantly, there is no Data Processing Agreement available on the free or Plus plans. A DPA is legally required under GDPR Article 28 any time you use a processor to handle personal data on behalf of your business. Without one, using ChatGPT for work involving personal data — client information, employee data, customer records — puts your business at legal risk.

The Team and Enterprise Plans — Genuinely GDPR Compliant

ChatGPT Team and Enterprise are a different story. OpenAI provides a full Data Processing Agreement, does not train on your data by default, and offers EU data processing options. These plans are suitable for business use in Europe.

Compliance Checklist

  • DPA available: Team and Enterprise plans only
  • No model training: Opt-out on free/Plus, off by default on Team/Enterprise
  • Data deletion available: You can delete your history and request data erasure
  • EU data residency: Not available as standard — data primarily processed in US under SCCs
  • EU AI Act readiness: OpenAI has published GPAI compliance commitments

What This Means for Your Business

Individual use, no personal data: The free plan is fine. Opt out of model training in settings.

Team use or any personal data involved: You need ChatGPT Team ($30/user/month) at minimum, and you should sign the DPA. Do not use the free or Plus plans for this.

Enterprise or regulated industries: ChatGPT Enterprise with EU processing options is the only appropriate choice. Alternatively, consider switching to a more GDPR-native alternative like Mistral AI.
